PETALING JAYA: The mother of a two-year-old girl who died after she was left in a car has been charged with negligence at the Sessions Court here.
Nur Sari Fardiana Mohd Amran, 38, pleaded not guilty to the charge read out by Judge Dr Syahliza Warnoh on Friday (Dec 22).
According to the charge sheet, the incident occurred between 8am and 3.15pm in the compound of a house in Ara Damansara found there was negligence involving a child aged two years old on Nov 8.
She was charged under Section 31(1)(a) of the Children Act 2001 for neglect, and if found guilty faces a jail sentence of up to no more than 20 years or fine up to RM50,000 or both, upon conviction.
Deputy Public Prosecutor Anis Hakimah Ibrahim suggested to the court to set bail at RM15,000 with one surety.
“The additional conditions must include the accused to report at the nearest police station every month and not bother any witnesses throughout the proceeding,” she said.
Lawyer Datuk Hanif Hassan however, requested for the court to set a lower bail of not more than RM5,000.
“RM15,000 set bail is too high compared to the trauma faced by my client who lost her own child and the victim of the case since the past month.
“She is also a businesswoman who had faced difficulties maintaining her business due to the incident because she was traumatised.
“My client is a Malaysian with no flight risk and has shown great cooperation throughout the proceeding,” he added.
The judge set bail of RM7,000 with one surety with the condition of reporting to the police station every month and prohibition from disturbing witnesses throughout the proceeding.
She also set January 30, next year for case mention.
