Court dismisses TNB's appeal against compensating factory worker RM40,000

KLANG: The High Court here dismissed an appeal by Tenaga Nasional Bhd (TNB) against an earlier decision by a magistrate’s court to award a factory worker RM40,000 as compensation.

Muhammad Eazrie Hafizie Md Aris had won the award last April after filing a counterclaim against TNB which had sued him for alleged meter-tampering and illegal usage of electricity worth RM26,811.75 in Dec 2021.

It was eventually found that Muhammad Eazrie Hafizie did not have an account with TNB nor was he in any way connected to the three-storey premise where the alleged meter tampering had taken place.

In the latest judgement on Friday (March 8), which was delivered through email by Justice Norliza Othman, TNB’s appeal was dismissed with a cost of RM5,000.

The earlier decision by the magistrate’s court for Muhammad Eazrie Hafizie to be awarded RM40,000 was also sustained.

In his counterclaim, Muhammad Eazrie Hafizie had claimed general, aggravated & exemplary damages from TNB.

According to Muhammad Eazrie Hafizie’s counsel Esmael Shah Shahrudin, his client had suffered from major depressive disorder and anxious distress after being sued by TNB.
